RTP Transformation Contest 2009:
Terms And Conditions
1. Eligibility:
• United States Resident Eligibility: The RTP Transformation Contest 2009 (the "Contest") presented to you by Adam Waters and the RTP Transformation System, is open to individuals who are legal residents of the 50 United States (except residents of Arizona, Vermont and Rhode Island) and the District of Columbia, and where local, state and federal laws permit. Entry and participation in this Contest is void where prohibited. The total round trip coach class airfare cost provided by the "Sponsor" to travel to New York City on the date of August 7, 2009 is US $1,500. Any additional airfare cost above US $1,500 is borne solely on the United States resident.
• International Countries' Resident Eligibility: International residents are also eligible to enter this Contest where their local, state and federal laws permit. Entry and participation in this Contest is void where prohibited. The total round trip coach class airfare cost to travel to New York City provided by the "Sponsor" to arrive on or before the date of August 7, 2009 is US $1,500. Any additional airfare cost above US $1,500 is borne solely on the "International" resident.
• Contestants must be eighteen (18) years of age or older at the time of entry.
Notwithstanding the forgoing, the following individuals are not eligible to participate:
• (i) professional bodybuilders (ii) individuals that endorse any supplements; (iii) Individuals that use any illegal steroids, drugs, hormones or intend to use them over the Contest duration (iii) Relatives of Adam Waters, Tom Venuto and Carlos DeJesus: means any of the following: spouse, ex-spouse, de facto spouse, child or step-child (whether nature or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Contest is subject to US federal, state, and local laws and regulations and is void in Arizona, Vermont, Rhode Island and is void in all towns, provinces, territories, municipalities, cities, states and countries where prohibited by law.
2. Sponsor And Administrator
• The Contest is sponsored by the RTP Transformation System, (the "Sponsor"). The Contest is administered by Adam Waters (the "Administrator").
3. Agreement To Official Rules:
• Participation in the Contest constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding.
4. How To Enter/Eligibility/Documentation:
You must complete each of the following steps to enter and participate:

• a. Purchase The RTP Transformation System digital eBook from http://www.RTP-Transformation-System.com before US PST (Pacific Standard Time) 11:59:59 Thursday, April 30, 2009. Purchases after US PST 11:59:59 PM April 30, 2009 do not qualify for Contest Entry You must have a valid receipt number from ClickBank.com to be eligible.
• b. Sign Your Agreement to the Official Entry Form: Included in your RTP Transformation System purchase is access to the “ShredderSphere 2.0” (located at ShredderSphere.com) support community website (the "Website"). These “Terms and Conditions” are located on the website. You will be asked to read and agree to these Official Rules on the website by “signing” your name on this page via a "Reply" to this Post. Your “signed agreement” must be submitted by US PST 11:59:59 PM, Sunday May 3, 2009.
• c. Transformation Challenge: Follow the RTP Transformation System 7 Steps as expressed in the 7 Modules including the 84 Day RTP Training and Nutrition Program for an 84-day period STARTING on or before US PST 11:59:59 PM Monday May 4, 2009.
• d. Transformation Documentation: Your 84-day transformation challenge must be documented inside the ShredderSphere.com private community (included in your purchase of the RTP Transformation System digital eBook) according to the 3 tenets of RTP External Accountability as set forth in Module 4: Pressurize of the RTP Transformation System digital eBook, i.e. Daily pictures, daily journalling and real time accountability logging on your “Internal Blog” inside ShredderSphere.com. A "valid" blog entry for each day of your 84-Day Transformation Campaign must be posted on ShredderSphere.com before US PST 11:59:59 PM at the close of each day. Failure to do so will result in deductions to your CAPS (Cumulative Accountability Compliance Score).
Note: Tutorial videos showing you how to set up your “Internal Blog” are contained in ShredderSphere.com., along with video tutorials showing you exactly how to log your daily CAPS (Cumulative Accountability Compliance Score).
• e. Time Frame: You will be judged over a consecutive 84-Day period in the time period between December 1, 2008 (includes people who purchased the RTP Transformation System prior to the announcement of the Contest) and US PST 11:59:59 PM, Sunday July 26, 2009. Ideally, this will be one documented “Mission” (as set forth in Module 3 of the RTP Transformation System). However, you are welcome to nominate your “best” 84-Day period between December 1, 2008 and July 26, 2009. The Contest officially ends on July 26, 2009 at US PST 11:59:59 PM, this is the deadline to publish your final 84-day results pictures on your "Internal Blog."
• f. Accountability Compliance: Eligible Contestants are those who have made a physique transformation on the full RTP Transformation System (including the 84-Day Training and Nutrition Plan) and documented their progress inside ShredderSphere.com implementing the three tenets of RTP External Accountability with a minimum CAPS (Cumulative Accountability Compliance Score) of 90%, as laid out in Module 4 of the RTP Transformation System, i.e. daily accountability pictures, daily journal and real time accountability compliance score.
N.B. Documenting your compliance score on a daily basis using the DAS (Daily Accountability Score), CAS (Cumulative Accountability Score) and overall CAPS (Cumulative Accountability Percentage Score) on your ShredderSphere.com blog is acceptable, i.e. you are not "required" to publish a full "screenshot" of your "real time accountability log" on a daily basis.
• h How Your Daily Accountability Score (DAS) Is Calculated:
(i) 6 points for correct meal intake (1 point for each meal on the RTP Nutrition Program),
(ii) 1 point for training session completed (RTP Training Program),
(iii) 1 point for daily picture (single "front" daily picture uploaded on your Blog),
(iv) 1 point for your journal (daily blog post published on ShredderSphere.com)
(v) 1 point for "mental training" (example: visualization, self-forgiveness statement, PRW internalization as expressed in Modules 1, 2 and 3 of the RTP System).
DAS - Daily Accountability Score: Your Daily Accountability Score (DAS) is a number out of 10, e.g. 9 out of 10 for Day 1.
CAS - Cumulative Accountability Score: If you were on Day 10, your CAS would be a number out of 100, e.g. 96 out of 100.
CAPS - Cumulative Accountability Percentage Score: After 84 days, your total CAS is a score out of 840, e.g. 800 out of 840. Therefore, your CAPS is 95.23% (800 divided by 840)
Extra Points Of Note: On non-training days you effectively have 1 "free point" awarded to your score due to the fact that no training is scheduled for this day. "Reward Meals" that are within the "RTP Recommended Guidelines" as articulated in Module 5: Energize of the RTP Transformation System for each 4-week phase (i.e. 3 "Reward Meals" per week on "RTP Base Training", two per week on "RTP Strength Training", one per week on "RTP Circuit Training"), do not count as deductions to your points. Additional "reward meals" over this "weekly allowance" are to be counted as deductions to your DAS.
Any attempted participation in any manner other than as expressly stated in these Official Rules is void and “entries” submitted via such means other than documentation inside ShredderSphere.com will NOT be accepted.
Please Note: Contestants are also free to document their journey on “externally hosted” blogs such as Blogger.com or WordPress.com in addition to their ShredderSphere.com “daily journalling.”
The Sponsor reserves the right to interpret these rules and, if necessary, to amend the rules at its sole discretion and without notice to individual RTP Transformation Contest 2009 participants. Any amendments to the rules or changes in prizes will be published online at www.RTP-Blog.com or www.ShredderSphere.com. Rule interpretations are final.
Each participant assumes all risk of injury, harm or loss of any kind arising from participation in the RTP Transformation Contest 2009. Consult with your physician or health care provider before starting any new exercise, nutrition or supplementation program, particularly if you suffer from any medical condition or regularly use prescription or over-the-counter medications. If you are not experienced with strength training, or if you are changing your exercise program, consult with a qualified trainer or coach. RTP Transformation Contest 2009 participants expressly release the Sponsor, its affiliated companies, and the directors, officers and employees of any of them from all risk, loss, injury, damage or harm that may arise from participating in the RTP Transformation Contest 2009.
5. (a) Requirements For Day 1/Day 84 Pictures:
Preface: The "date and time stamping" feature of the ShredderSphere.com "Internal Blog" System ensures that each blog entry over the duration of each Contestant's 12-Week "Transformation Campaign" (specifically Day 1 and Day 84) is absolute proof that before and after pictures are 84 days apart.
The following "Picture Rules and Suggestions" apply to each Contestant's official before and after pictures taken on Day 1 and Day 84 of their transformation campaign. While daily picture accountability is highly encouraged and a critical component of the RTP Transformation System the "Picture Rules and Suggestions" outlined below relate only to each Contestant's official Day 1 and Day 84 pictures.
Note: The degree to which each Contestant implements daily accountability pictures will affect their overall CAPS - Cumulative Accountability Percentage Score - and thus impact their chances of winning the Contest.
• Your Day 1/Day 84 Before and After Pictures must comply with the following requirements:
(a) Your "official" Before and After Pictures (Day 1 and Day 84) must be clear, unambiguous "front pictures" of yourself documented within the ShredderSphere.com community website "internal blogging" system uploaded by the deadline expressed above, (b) Only you and no one else can appear in the picture, (c) Recommendation: take your official before and after photos in shorts; women: shorts and sports bra/top. Or wear swimsuits.
5. (b) Suggestions For Day 1/Day 84 Pictures:
• (a) Day 1/Day 84 Pictures should be taken with the same lighting and background; (b) Day 1/Day 84 Pictures should be taken in multiple poses, including front relaxed, back relaxed and side; (c) Day 1/Day 84 Pictures should be taken with you wearing the same color and style of clothing (see Adam Waters example from prior Missions); (d) you must have substantially the same hair-style and (if applicable) makeup in your Day 1/Day 84 Pictures; (e) one (1) for extra "Proof" one of the Before Pictures and one (1) of the After Pictures can show you holding a national newspaper with the date clearly visible; (f) additionally, one (1) of the Before Pictures and one (1) of the After Pictures can be a close-up photograph of the national newspaper with the date clearly visible and (g) only you and no one else may appear in the Picture.
• If Sponsor and/or Administrator, in the sole discretion of either party, has reason to believe that a Picture contains any material that may infringe or violate the rights of a third party, Sponsor may disqualify such Picture (and the entrant submitting the same) without notification to entrant and take all other measures as Sponsor deems necessary and appropriate, in its sole discretion, so as to protect its rights. Pictures may not be submitted jointly by more than one (1) entrant or depict a group of entrants; each entry may only list a single individual as the entrant.
• Pictures that in the sole discretion of Sponsor are indecent, inappropriate, offensive or otherwise unfit for publication will be disqualified without notification to entrant; Pictures that, in Sponsor's sole discretion, contain acts of violence or that advocate reckless behavior will also be disqualified. All Pictures that are not in full compliance with these Official Rules will be disqualified without notification to entrant.
6. Submission Of Entries:
• By submitting an entry, you represent the following:
• (a) your “Daily Journal” posted on your ShredderSphere.com "Internal Blog" is your original work; (b) your CAPS "Cumulative Accountability Compliance Score" posted on your ShredderSphere.com "Internal Blog" is true and accurately reflects your accountability compliance during your transformation campaign; (c) your Day 1/Day 84 Before and After Pictures (including daily pictures) are accurate depictions of yourself; (d) neither the Day 1/Day 84 Before nor After Pictures have been retouched, altered, and/or distorted in any way whatsoever; (e) no mock-up or other device, special camera, or other techniques were used to distort or otherwise misrepresent your appearance in the Day 1/Day 84 Before or After Pictures; (f) the differences seen in the Day 1/Day 84 Before and After Pictures are attributable to your hard work, dedication (no drugs or steroids or growth hormones) and the RTP Transformation System 7 Steps (including the 84-day RTP Training Program and RTP Nutrition Program); and (g) the Pictures do not violate the trademark, copyright, intellectual property or other rights of any third party.
7. Sponsor's Rights To Submissions:
• By submitting an entry, you grant to the Sponsor the right in perpetuity to reproduce, publish, and use your Pictures, story, name, biographical information in any and all media, without limitation and without further compensation. By submitting an “entry”, you warrant that you have the ability to grant the aforementioned rights to the Sponsor and its agents. The copyright of the "before and after" images remains with the Contestant.
• You further agree not to instigate, support, maintain or authorize any action, claim or lawsuit against the Sponsor, or its agents, on the grounds that any use of the Pictures or “Journal”, or any of derivative works, infringes your rights. You further agree to release and hold the Sponsor harmless in the event that any third party instigates such an action against the Sponsor. Nothing herein shall constitute an employment, joint venture, or partnership relationship between you and the Sponsor.
8. Judging:
Preface:
• The likelihood of winning depends upon the number of entries received, and the quality of your entry compared to the quality of all other entry submissions as determined by the judges and ShredderSphere.com Members.
Shortlist Judging: July 26, 2009
• On July 26, 2009, a panel of “Judges” (Adam Waters, Tom Venuto Carlos DeJesus) will evaluate all entries that achieved a CAPS "Cumulative Accountability Compliance Score" above 90% ("Eligible Entries"). Eligible Entries will be judged according to the following criteria (the "Judging Criteria"): (a) extent of an entrant's transformation (75%); and (b) how inspirational their story is as documented via their “Internal Blog” on ShredderSphere.com (25%). In the event of a tie, the “Journals” of each tied entry will be judged an additional time until a potential "Shortlist" winner is determined.
ShredderSphere.com Member Voting: July 27, 2009
• The Judges will narrow down a "Shortlist" of a certain quota of men and a certain quota of women (relative and appropriate to the quality of submissions and the total number of participants in the Contest). The Shortlist of Men and Women will then be voted upon in a "blind" vote (running vote totals will not be visible to Members during the voting process) by current ShredderSphere.com Members using the "Internal Poll" software contained on ShredderSphere.com (strictly limited to one IP Address per vote) for the 24-hour period between US PST 12:01 AM on July 27, 2009 and US PST 11:59 PM July 27, 2009). All ShredderSphere.com Members across all time zones will have adequate time to place their vote. The male contestant and the female contestant with the highest number of votes by 11:59 PM July 27, 2009 shall be deemed the "provisional winners" subject to "Requirements of Potential Winners" being fulfilled.
.Note: The "Shortlist" quota for men and women will be announced on May 15, 2009.
• The decisions of the judges with respect to the "Shortlist" and selection of the potential winners by the ShredderSphere.com "Internal Vote" and all other matters related to the Contest shall be final and binding in all respects. Potential winners will be notified by email/phone on July 28, 2009, and must respond within 3 days of being notified. In the event a potential winner notification is returned as undeliverable, an alternate entrant will be selected based on the Judging Criteria (i.e. 2nd Place getter in the ShredderSphere.com "Online Poll.")
Important: "Potential Winners" who are in the "running" are advised to “clear” their schedule for Friday August 7, 2009, Saturday, August 8, 2009 and Sunday August 9, 2009 well in advance so they are able to claim their prizes should they win.
9. Requirements Of Potential Winners:
• Except where prohibited, a potential winner will be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within three (3) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant will be selected in his/her place according to the Judging Criteria. If a potential winner is a minor, his/her parent or legal guardian must sign the Affidavit/Release on the potential winner's behalf. In order to be eligible to win a prize, a potential winner must continue to meet the eligibility requirements set forth above at the time the prize is awarded.
10. Prizes:
• a. First Prize: Two (2) First Prizes (1 male and one female) winner will receive the following elements. The approximate value of the Prize is between US $2,000 and US $2,500 (depending on the cost of the airfare).
• 1 training session with Adam Waters and Tom Venuto in New Jersey on August 8, 2009.
• 1 “professional picture” shoot with Adam Waters and Tom Venuto on August 8, 2009.
• 1 dinner with Adam Waters and Tom Venuto on August 8, 2009.
• 1 ticket to a Broadway Show with Adam Waters and Tom Venuto on August 8, 2009.
• Transport to each location on "Event Day" (August 8, 2009) will be provided by Tom Venuto.
• The prize includes: (a) round-trip coach-class airfare for one (1) from the airport closest to the winners' residence to New York City (JFK Airport), the maximum amount the Sponsor will contribute for airfare cost to travel to New York City is US $1,500; The winner must pay for the airline ticket up front, the winner will be redeemed the total cost of the airfare after sending Adam Waters the Airfare receipt via a scanned copy sent via email. Upon successful verification of the Airfare receipt the winner will receive a "Wire Transfer" of the cost of the airfare deposited into their bank account within 10 days after booking.The Winner is responsible for booking the airfare and shall book at the ticket at "reasonable" cost with no additional "Stopovers" or "Upgrades" above the base price.(b) hotel accommodations selected by Sponsor in one (1) room for two nights at W. Hotel Hoboken on the 7th and 8th of August, 2009 with check-in available from 3:00PM onwards on Friday August 7, 2009 and check-out on Sunday August 9, 2009 at 12:00PM ; and (c) US $500.00 in spending money.
• 1 “Time Lapse” video documenting your 84 days transformation which Adam Waters will help you create for publishing for online and offline media. You will also receive marketing advice from Adam Waters on how you can generate mainstream media coverage for your transformation with the objective of deriving affiliate sales from the RTP Transformation System affiliate program (conducted through ClickBank.com) via the publishing and promotion of your “time lapse” video and your “real time”story.
• The male and female winner's "success story" will be featured in RTP Transformation System 2.0 eBook due for release in late 2009.
b. For All Prizes: Any details not specified above will be determined by the Sponsor, in its sole discretion. All meals, gratuities and all other expenses not specified above are the responsibility of the winner. Prizes are not transferable or refundable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a cash or non cash prize (or component thereof) of equal or greater value if the First Prize (or component thereof) is not available for any reason as determined by the Sponsor in its sole discretion. Prizes will be reported as income to each winner and each winner will be responsible for all taxes associated with the receipt of a prize.
11. General Conditions:
• In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) select winners according to the Judging Criteria from among the entries received at the time of impairment.
• IN NO EVENT WILL SPONSOR, ADMINISTRATOR BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR UPLOADING TO OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE CONTEST SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
• The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Contest or to be acting in violation of these Official Rules or in an un sportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Release And Limitations Of Liability:
• By participating in the Contest, participants agree to release and hold harmless the Sponsor, its related companies, and their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) printing errors; (c) errors in the administration of the Contest or the processing of entries; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant's use of the RTP Transformation System, participation in the Contest, or use of any prize.
• Participant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney's fees. Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
13. Disputes:
• Except where prohibited, participant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court.
14. Winners List:
• The Winners (along with their before and after pictures) will be published on //www.RTP-Blog.com and www.ShredderSphere.com and www.RTP-Transformation-System.com on or before July 31, 2009.
